Rubbish Removal Tufnell Park Service Terms and Conditions

These Terms and Conditions set out the basis on which we provide rubbish removal and waste collection services in and around Tufnell Park. By making a booking, confirming a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any service.

1. Definitions

In these Terms and Conditions, the following expressions shall have the following meanings:

1.1 Service means any rubbish removal, waste collection, clearance, loading, transportation, disposal, recycling, or related work that we agree to perform for you.

1.2 We, us and our refer to the rubbish removal service provider operating under the name Rubbish Removal Tufnell Park.

1.3 You and your refer to the customer, whether an individual, partnership, company, landlord, tenant, managing agent, or any other party that orders or receives the Service.

1.4 Premises means the property, land, building, or location where the Service is to be carried out.

1.5 Waste means any rubbish, junk, household waste, garden waste, construction waste, commercial waste, or other items that you ask us to remove, subject to any exclusions set out in these Terms and Conditions.

2. Scope of Service

2.1 We provide waste collection and rubbish removal services within Tufnell Park and surrounding areas. The exact scope of each Service will be as described in our quotation or booking confirmation.

2.2 Unless expressly stated otherwise, our Service includes the labour required to load the Waste onto our vehicle, transport it, and dispose of it or recycle it in accordance with applicable waste regulations.

2.3 We reserve the right to refuse to remove any items that we reasonably believe to be hazardous, illegal, contaminated, excessively heavy, or beyond the agreed scope of the Service.

3. Booking Process

3.1 You may request a booking by telephone, email, or through our online enquiry channels, providing accurate details of the type and quantity of Waste, the access to the Premises, and the preferred date and time for collection.

3.2 Any quotation we provide is based on the information you supply. If the actual Waste or site conditions differ from what you described, we may revise the price or decline to carry out the Service.

3.3 A booking is only confirmed when we issue a booking confirmation and you accept it. This may be done verbally, by email, text message, or in writing, depending on the communication method used.

3.4 Same-day or short-notice bookings are subject to availability. We do not guarantee any particular time slot but will use reasonable efforts to attend within the agreed window.

3.5 You must ensure that a responsible adult aged 18 or over is present at the Premises at the time of collection, unless we have agreed alternative arrangements in advance.

4. Access and Preparation

4.1 You are responsible for providing safe, clear, and reasonable access to the Premises and to the Waste to be collected. This includes arranging parking permissions or permits where necessary.

4.2 If our vehicle cannot park near the Premises or access is obstructed, we may charge additional labour or waiting time fees, or we may rearrange or cancel the Service and charge a call-out fee.

4.3 You should separate any items that you wish to keep from the Waste before our operatives arrive. We accept no liability for items that are removed as Waste where they were not clearly designated as items to be retained.

4.4 Where Waste is located in lofts, basements, or other confined spaces, we may require you to move it to an accessible area or we may charge an additional fee for the extra labour and time involved.

5. Pricing and Quotations

5.1 Our pricing is generally based on the volume, weight, and type of Waste, as well as the time and labour required to complete the collection in Tufnell Park and nearby areas.

5.2 Any quote given in advance is an estimate only, based on the information you provide. The final price will be confirmed on site once our operatives have inspected the Waste.

5.3 If you decide not to proceed with the Service after we arrive and provide a final price, we reserve the right to charge a call-out fee to cover our time and travel costs.

5.4 All prices are exclusive of any applicable taxes unless stated otherwise. Where VAT or similar taxes apply, they will be added to the final invoice in accordance with current law.

6. Payments

6.1 Unless we agree credit terms in writing, payment is due in full upon completion of the Service on the day of collection.

6.2 We accept typical forms of payment such as cash, major debit and credit cards, and bank transfers, subject to our current payment facilities.

6.3 For account customers or commercial clients with agreed payment terms, invoices must be paid by the due date specified on the invoice. We reserve the right to charge interest and administrative fees on overdue amounts in accordance with applicable UK legislation.

6.4 If payment is not received as required, we may suspend further services, pursue debt recovery, and recover from you all reasonable costs and expenses incurred in obtaining payment.

7. Cancellations and Amendments

7.1 You may cancel or amend a booking by contacting us directly during our normal business hours.

7.2 If you cancel a booking more than 24 hours before the agreed collection time, no cancellation charge will normally apply.

7.3 If you cancel a booking less than 24 hours before the agreed collection time, we may charge a cancellation fee to cover our allocated resources and lost opportunity.

7.4 If our operatives attend the Premises at the agreed time and are unable to carry out the Service due to circumstances within your control, such as lack of access, absence of an authorised person, or incorrect information regarding the Waste, we may treat this as a late cancellation and charge a call-out fee.

7.5 We may cancel or reschedule a booking at any time due to operational reasons, safety concerns, severe weather, vehicle breakdown, staff illness, or any event beyond our reasonable control. In such cases, we will aim to offer an alternative date and time but shall not be liable for any resulting loss or inconvenience.

8. Waste Regulations and Prohibited Items

8.1 We operate in accordance with relevant UK waste management legislation and regulations. All Waste collected will be transported, treated, recycled, or disposed of using licensed facilities and approved methods.

8.2 You agree not to present for collection any Waste that is hazardous, toxic, explosive, highly flammable, or otherwise restricted under UK waste law, including but not limited to asbestos, chemicals, solvents, oils, gas cylinders, certain electrical equipment, and clinical or biological waste, unless we have expressly agreed in writing to handle such items and you have provided all required documentation.

8.3 You must inform us in advance if any Waste may contain sharp objects, glass, or materials that could present a risk to health and safety. We reserve the right to refuse collection of any items that we consider unsafe.

8.4 You confirm that you have full authority to dispose of the Waste and that its removal will not infringe any third-party rights or breach any lease, tenancy, or property agreement.

9. Customer Obligations

9.1 You shall cooperate with our operatives and provide all information reasonably required to carry out the Service safely and efficiently.

9.2 You must ensure that any fragile surfaces, flooring, or fixtures are adequately protected where necessary. Our operatives will take reasonable care but are not responsible for ordinary wear and tear caused by moving heavy or bulky items through the Premises.

9.3 You agree not to obstruct or interfere with the Service and to keep children, pets, and bystanders at a safe distance while our operatives are working.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law.

10.2 Subject to clause 10.1, we shall not be liable for any indirect, consequential, or purely economic loss, including loss of profit, business interruption, or loss of opportunity, arising out of or in connection with the Service.

10.3 Our total aggregate liability to you in respect of any claim arising from the Service, whether in contract, tort, or otherwise, shall not exceed the amount paid or payable by you for the specific Service giving rise to the claim.

10.4 We are not responsible for pre-existing damage at the Premises or to any items. You should point out any areas of concern before the Service begins.

10.5 We shall have no liability where any loss or damage results from your failure to comply with these Terms and Conditions, from inaccurate information provided by you, or from events beyond our reasonable control.

11. Complaints and Disputes

11.1 If you are dissatisfied with any aspect of the Service, you should notify us as soon as possible, and in any event within 48 hours of completion, providing full details of your concerns.

11.2 We will investigate your complaint and may request additional information or evidence. Where appropriate, we will seek to agree a fair and reasonable resolution with you.

11.3 If a dispute cannot be resolved between us through our internal process, either party may seek to pursue their rights through the UK courts in accordance with clause 15.

12. Insurance

12.1 We maintain insurance cover appropriate for a rubbish removal and waste collection service operating in the UK, including public liability insurance, subject to the policy terms, conditions, and exclusions.

12.2 Our insurance does not replace your own contents or buildings insurance, and you remain responsible for ensuring you have appropriate cover for your Premises and possessions.

13. Data Protection and Privacy

13.1 We collect and process personal data such as your name, contact details, address, and payment information for the purpose of administering bookings, carrying out the Service, and meeting our legal obligations.

13.2 Your information will be handled in accordance with applicable UK data protection laws. We will not sell your data to third parties and will only share it where necessary to provide the Service, process payments, comply with the law, or manage our business operations.

13.3 By using our Service, you consent to the processing of your personal data for these purposes. You may have rights to access, correct, or request deletion of your data, subject to legal requirements.

14. Changes to these Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, industry practice, or our business operations.

14.2 The version of the Terms and Conditions in force at the time of your booking will apply to that Service. We recommend that you review these terms periodically if you use our services regularly in the Tufnell Park area.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the Service provided by Rubbish Removal Tufnell Park.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed deleted and the remaining provisions shall remain in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

16.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where necessary for the efficient delivery of the Service.

16.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the Service and supersede any previous understandings, discussions, or agreements, whether written or oral, regarding the subject matter.
